Photography Services Agreement

Thank you for choosing Don Hector Studios. This agreement outlines the terms of our engagement. Please read each section carefully and initial to confirm your understanding.
Section 01
Parties & Agreement
This Photography Services Agreement is entered into by and between Don Hector Brands Group LLC, a Florida Limited Liability Company operating as Don Hector Studios ("Photographer"), and Client ("Client").

Section 02
Scope of Work & Session Details
Photographer agrees to provide professional photography services as follows: Photography session — Selected package. Session Date: —. Duration: As agreed. Location: As agreed.
Any changes to session type, location, duration, or deliverables after signing must be approved in writing and may incur additional fees.
Standard editing — color correction, exposure adjustment, and light retouching — is included. Advanced retouching — skin correction, teeth whitening, hair, and feature work — is a separate paid add-on. No advanced retouching will be performed without written request and confirmed payment.

Section 03
Deliverables
Client will receive professionally edited JPEG images delivered via private online gallery. Delivery timeline begins from the date Client completes their image selections and full payment is received.
Client will have access to a culled proofing gallery to make their selections. Photographer is not obligated to deliver every image captured and may remove images that do not meet quality standards.
RAW files will not be provided under any circumstance. All delivered images will be professionally edited JPEGs only. This policy is absolute.

Payment Terms
Total session fee: $0.00. A non-refundable booking fee of $50.00 is required to secure the session date. The remaining balance of $0.00 is due on the day of the session before the session begins.
No proof gallery, preview images, or final delivered images will be released until all fees have been received in full. Accepted payment methods: Credit/Debit Card, Zelle, Cash.

Rescheduling & Cancellations
The $50.00 booking fee is non-refundable under all circumstances. One reschedule is permitted with at least 48 hours written notice — the booking fee transfers to the new date. A second reschedule requires a new booking fee.
No-show policy: Failure to attend without prior notice results in forfeiture of the booking fee. The session will not be rescheduled without a new booking fee.

Copyright & Usage Rights
All photographs are the exclusive intellectual property of the Photographer. Upon full payment, Client receives a limited, non-exclusive, non-transferable license for personal use only — personal printing and personal social media sharing.
No alterations permitted. Client may not apply filters, color changes, cropping that alters composition, retouching, or any other alteration. Images shared publicly must be displayed exactly as delivered. Commercial use requires a separate written licensing agreement.

Photographer's Right to Use Images
Client grants Photographer permission to use images from this session for portfolio, website, social media, and promotional purposes. If Client does not wish images to be used promotionally, written notice must be provided at least 48 hours before the session.

Section 08
Client Responsibilities
Client agrees to: arrive on time and prepared with agreed wardrobe and looks; ensure hair, makeup, and grooming are complete before the session — the Photographer is not responsible for appearance-related results due to client arriving unprepared; treat all equipment and sets with care; and conduct themselves respectfully throughout the session.
Professional conduct: Photographer reserves the right to terminate the session immediately without refund if Client or Client's guests engage in abusive, threatening, or disrespectful behavior.

Section 09
Liability & Governing Law
Photographer is not liable for circumstances beyond reasonable control, including illness, emergency, severe weather, equipment failure, or other unforeseen events. In such cases, Client may choose a full refund or rescheduled session at no additional cost.
This Agreement is governed by the laws of the State of Florida. Any disputes shall be subject to the exclusive jurisdiction of the courts of Polk County, Florida. This document constitutes the entire agreement between the parties.
